What is the Social Security Disability Program?
It is a program for disabled persons. To quality you must be disabled and have generally worked 5 out of the last 10 years. If you have not worked 5 out of the last 10 years and are disabled, you might receive Supplemental Security Income Benefits (SSI) depending on your resources.
How does Social Security Disability affect medical care?
After you have been on Social Security Disability for 2 years, you can receive a Medicare Card for your major medical expenses and certain prescriptions. If you receive SSI benefits you can get a Medical Card the first month you are entitled to SSI.
Am I disabled according to Social Security requirements?
If you have a physical or mental problem or problems that keep you from working at a regular paying job for at least 12 months, you are disabled. Your disability cannot be a drug or alcohol addiction.
File an application with your local Social Security Office. Most claims are denied. When you are denied you have 60 days to file for a Reconsideration of your claim. If you are denied again, you have 60 days to request a hearing. YOU SHOULD CONTACT OUR OFFICE WHEN YOUR CLAIM IS FIRST DENIED.
What is the Social Security Hearing?
This is the most important part of your case. A hearing is held before a Social Security Judge who decides if you are disabled and entitled to benefits. An attorney from our office will prepare you for the hearing and represent you at the hearing. We will help you present testimony to show that you are disabled and we will ask questions of any medical or rehabilitation expert at the hearing. If we win your case, you should receive your money within 2-3 months.
What fees or other costs do I have to pay the attorney?
If you lose your case, you do not have to pay any attorney fees. If you win, our fee in no more than 25% of any back benefits, plus costs. Our fee has to be approved by the Social Security Administration.
Our office only charges for our services if we are successful. However, you are responsible for paying all costs involved in handling you case including copying your Social Security file and any doctor records or reports that are needed for your case.
Do I need an attorney to help me with my Social Security Case?
You may represent yourself in your Social Security Case. However, your chances of winning are better with an attorney who understands the Social Security system and can present the necessary evidence to win your case.
